San Francisco Chronicle: In July the city of Berkeley, California, passed an ordinance requiring cell-phone retailers to warn customers about the health risks of prolonged exposure to RF radiation emitted by the devices. The wireless industry challenged the ordinance, claiming there is no scientific evidence to support that claim. On Monday US District Judge Edward Chen rejected the request for a preliminary injunction. Chen says the law is consistent with Federal Communications Commission statements and “there is a reasonable scientific basis to believe that (radio-frequency) radiation at some levels" can and does present health risks. Chen did require, however, that the phrase saying the risk is greater for children be removed, on the grounds that that remains to be proven.
